These Terms of Service ("Terms") govern your access to and use of the Sleepery website and your purchase of products from Sleepery Pty Ltd (ABN 19 501 594 991) ("Sleepery", "we", "us", "our"). By using this website or placing an order, you agree to these Terms. Please also read our Privacy Policy, Returns & Refunds Policy, Shipping Policy and Medical Disclaimer, which form part of these Terms.
1. Use of our website
You may use this website for lawful purposes only. You must not misuse the site, interfere with its operation, attempt to gain unauthorised access, or use it in any way that breaches any applicable law. Content on this site is provided for general information and may change without notice.
2. Accounts
If you create an account, you are responsible for keeping your login details secure and for activity that occurs under your account. Please notify us promptly of any unauthorised use.
3. Products, pricing and availability
All prices are in Australian Dollars (AUD) and include GST unless stated otherwise. We try to ensure product descriptions, images and prices are accurate, but errors may occur. Where we discover an error in the price or description of an item you have ordered, we may cancel the order and refund any amount paid, or contact you to ask whether you wish to proceed. Product availability is not guaranteed and we may limit quantities.
4. Orders and acceptance
Your order is an offer to purchase. We may accept or decline any order. A binding contract is formed when we dispatch the goods to you (or notify you that they have been dispatched). We may refuse or cancel an order, including where a product is unavailable, where there has been a pricing or description error, or where we suspect fraud.
5. Payment
Payment is processed through our third-party payment providers at checkout. You confirm that you are authorised to use the payment method provided. We do not store full card details.
6. Delivery and returns
Delivery is governed by our Shipping Policy and returns by our Returns & Refunds Policy. Risk in the goods passes to you on delivery.
7. Consumer guarantees (Australian Consumer Law)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
8. Product information and health
Product descriptions, specifications, statistics and any health-related or wellbeing statements are provided for general information only and are drawn from manufacturers, suppliers and publicly available research. They are not guarantees of any particular outcome, and individual results vary. Nothing on this site is medical advice — please read our Medical Disclaimer and consult a qualified healthcare professional about your own health.
9. Intellectual property
All trademarks, logos, text, images and design elements on this site are owned by or licensed to Sleepery and are protected by law. Third-party brand names and trademarks (including Zeus, Sunbeam, Philips, Shark, Oura, WHOOP, Withings, Loftie and Soundcore) are the property of their respective owners and are used to describe the products we sell. You may not reproduce our content without our written permission.
10. Third-party products, services and links
We sell products manufactured by third parties and may link to third-party sites or services (for example, membership or app services that accompany certain devices). We are not responsible for the content, terms or practices of third parties, and your use of their services is governed by their terms.
11. Limitation of liability
To the maximum extent permitted by law, and subject to the consumer guarantees in clause 7, Sleepery is not liable for any indirect, incidental, special or consequential loss arising from your use of this website or any product purchased through it. Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to resupplying the goods or paying the cost of resupply.
12. Indemnity
You agree to indemnify Sleepery against any loss or claim arising from your breach of these Terms or your unlawful use of the website, except to the extent caused by us.
13. Privacy
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
14. Governing law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
15. Changes to these Terms
We may update these Terms from time to time. The version published on this website at the time you place an order applies to that order. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
